Does Pet Liability Insurance Work Differently for Service and Emotional Support Animals?

Does pet liability insurance work the same for service animals

This guide is part of our series on pet liability coverage and tenant insurance

Not every pet serves the same purpose in your home. But does that matter when it comes to the pet liability coverage aspect of your tenant insurance? Read this informative guide to understand whether a pet, service, or emotional support animal might be treated if you need to make an insurance claim when renting.

Understanding what is or isn't classified as a service animal

Pets, service animals, and emotional support animals all offer something different for owners. If you’re not sure what category your companion falls into, here's what distinguishes one from the other:

    • Service animals. These are generally defined as animals individually trained to perform specific tasks for a person with a disability – for example, guide dogs for people who are visually impaired, or dogs trained to detect medical episodes like seizures. In most Canadian provinces, service animals have legal protections around access to housing and public spaces, though the exact criteria for qualification can vary by province.

    • Emotional support animals. These kinds of animals often provide comfort through companionship but typically aren't trained to perform specific tasks. Their legal status is often less clearly defined than that of service animals, and recognition can depend on documentation from a healthcare provider rather than formal certification.

    • Pets. By contrast, pets are animals kept for companionship without a task-based or therapeutic designation tied to a disability. They’re often just thought of as an extended member of the household, serving no purpose other than to live alongside you.

Does liability coverage treat some animals differently?

Ultimately, the role or purpose of an animal in your home won’t necessarily mean that a provider treats them differently when it comes to a tenant insurance policy. In general, liability coverage responds to the incident – such as a bite or injury caused by the animal – rather than the animal's designation.

That said, there are still some considerations to keep in mind:

    • An animal's designation may factor into how an insurer assesses risk history, particularly if breed or behavioural exclusions are part of the policy.

    • Documentation for a service or emotional support animal doesn't necessarily change liability exposure if that animal causes injury or property damage.

    • Some insurers may ask about an animal's role (service, emotional support, or pet) as part of the application process, even if it doesn't change the underlying liability terms.

Everyone will treat these circumstances in their own way, using unique rules and policies. While most tenant insurance providers make decisions based on the breed, species and history of the pet, rather than their role or responsibilities, there’ll always be exceptions. Try to find out what these are before committing to any policy.

When might your animal not be covered?

Coverage can depend on a combination of factors, and it's worth reviewing your policy closely rather than assuming anything before making a claim. As we’ve discussed, the role of your pet, emotional support or service animal usually won’t impact your coverage.

What often matters more are factors such as:

    • Policy wording. Some policies may explicitly address service or emotional support animals, while others may simply apply general pet liability terms regardless of designation.

    • Breed and behavioural exclusions. A dog's status as a service animal typically doesn't exempt it from breed-specific exclusions if your policy includes them.

    • Documentation. If you're claiming a service or emotional support designation, your insurer may ask for supporting documentation, particularly if it's relevant to a claim.

    • Where the incident occurs. Some policies distinguish between incidents that happen at home versus in public spaces.

Again, it’s a good idea to check what your specific policy says so you know what is likely or not likely to be covered for you.

Important factors renters with pets should keep in mind

If you are considering getting tenant insurance, and want to know how your pet might impact your policy, remember to think about the following factors:

    • Always get clarity. Don't assume a designation automatically changes your coverage. Check your policy wording directly, or ask your insurer.

    • Have evidence. Keep documentation on hand if your animal is a certified service animal or has supporting paperwork as an emotional support animal, in case it's requested during underwriting or a claim.

    • Know what kind of animals you’re allowed. Understand your building's pet policies separately from your insurance policy. Landlord rules around service and emotional support animals are governed by different rules than what your insurer covers.

    • Check breed rules. Review breed and behavioural exclusions carefully, since these can apply regardless of your animal's role.

    • Speak to a provider. Ask your insurer directly if you're unsure how your policy treats your specific situation – general guidance won't always reflect the exact details of your plan.
