    When a fire is traced back to something within a rented unit, the question of who's responsible for the resulting damage doesn't always have a simple answer. It depends on how the fire started, what it affected, and how the various parties were involved.

    But what happens if you are found to be the cause? In this guide, we’ll discuss exactly that. Read on to find out who is responsible for what, and how your tenant insurance can step in to support you financially. 

    Who's responsible for damages when a tenant causes a fire?

    Responsibility in these situations generally falls to how the fire ignited, rather than whose unit it started in. If a fire is traced back to something within a tenant's control, such as an unattended cooking pot or a poorly maintained appliance, a renter may be considered responsible for damage that follows, even though the building itself belongs to someone else. If the cause is tied to a building-wide issue, such as faulty wiring they had no involvement with, responsibility might lie with the landlord or property owner instead. 

    Does a landlord’s insurance cover any of the responsibility of repairs?

    A landlord's insurance policy applies to the structure of the building and the landlord's own property, rather than a tenant's actions or belongings. Because of this, a landlord's insurer paying to repair the building doesn't necessarily mean the situation is fully resolved legally from a tenant's perspective if they’re found responsible for starting the fire. Being covered under the landlord's policy for repairs and being considered responsible for causing the damage are typically treated as two separate things.

    What personal liability coverage usually pays for after a fire 

    If you are found to be responsible for an accidental fire, a tenant insurance policy can offer financial support with legal and practical costs. This usually extends to help with things like:

    • Damage to neighbouring property. If a fire that starts in your unit spreads and damages a neighbour's home, fence, condo unit, or other structure, personal liability coverage can help pay for repairs. This may include structural damage, damaged belongings inside the affected property, and in some cases, temporary repairs needed to prevent further loss.

    • Third-party bodily injury. If a guest, neighbour, or other third party is injured as a result of the fire, liability coverage may help cover their medical bills, rehabilitation costs, and related expenses. This can extend to ongoing care if injuries require long-term treatment, subject to your policy's limits.

    • Legal defense fees. If you're sued for negligence in connection with the fire, this coverage may help pay for legal defense costs, including lawyer retainers and court fees, as well as any settlement or judgment awarded against you, up to your policy's liability limit.

    After paying for repairs, a landlord's insurer may look into what caused the fire and whether another party's actions contributed to the loss. In some cases, this can lead to the insurer seeking to recover what it paid from the party considered responsible, a process generally connected to how the cause of the fire is determined. Whether this happens, and how far it goes legally, tends to depend heavily on the specifics of the situation.

    What can happen if you don’t have tenant insurance? 

    Without personal liability coverage as part of a tenant insurance policy, a renter found responsible for this kind of damage may need to personally cover repair costs, replacement expenses, or legal fees that a policy would otherwise help offset. How significant this becomes tends to depend on the extent of the damage and how the situation is ultimately resolved between the parties involved.
